What is the difference between a wasiat and hibah? +
A wasiat is a written will under Islamic law, which takes effect after death and is limited to one-third of the estate for non-heirs. Hibah is a gift made during one's lifetime that transfers ownership immediately. Both are useful tools in estate planning, and the right approach depends on your situation. We will explain both clearly during your consultation.
Do I need a lawyer to apply for a grant of probate in Malaysia? +
While it is technically possible to apply without legal representation, the process involves careful preparation of court documents and can become complicated, particularly where there are multiple beneficiaries or disputes. Having a qualified practitioner manage the process helps avoid delays and errors that are difficult to correct later.
How long does estate administration typically take? +
Timelines vary depending on the complexity of the estate, whether a will exists, and how promptly third parties respond. A straightforward matter may be settled in a few months; more involved cases can take longer. We keep you informed at each stage and do not leave you waiting without explanation.
What does faraid mean, and does it apply to me? +
Faraid refers to the Islamic law of inheritance, which sets out fixed shares for eligible heirs. In Malaysia, it applies to the estates of Muslims. For non-Muslims, civil law governs distribution under the Distribution Act 1958. We work within both frameworks and can advise which applies to your family's circumstances.
