1. Definitions

In this Agreement, the following terms carry the meanings stated below:

• "Service" — Any estate planning consultation, estate administration support, or complete legacy engagement offered by Lestari, as described in our service schedule.
• "User" / "Client" — Any individual or family who engages Lestari for the purpose of estate planning or administration.
• "We / Us / Our" — Lestari, operating from Suite 6-4, Plaza Sentral, Jalan Stesen Sentral 5, 50470 Kuala Lumpur, Malaysia.
• "Content" — All materials, documents, written summaries, estate records, and other outputs produced in the course of delivering the Service.
• "Agreement" — This document, together with any engagement letter, service schedule, or written correspondence that forms part of the service arrangement.
• "Faraid" — The system of Islamic inheritance distribution applicable under Malaysian law.
• "Wasiat" — A testamentary instrument (will) under Malaysian law.

2. Acceptance of Terms

By engaging Lestari's services — whether by submitting an enquiry, attending a consultation, or signing an engagement letter — you confirm that:

• You are at least 18 years of age or the legal age of majority in your jurisdiction.
• You have the legal capacity to enter into a binding agreement.
• The information you provide to us is accurate and complete to the best of your knowledge.
• You are acting on your own behalf, or have the appropriate authority to act on behalf of others named in the matter.

If you do not agree to these terms, please do not proceed with engaging our services.

3. Service Description

Lestari provides the following services to individuals and families in Malaysia:

• Estate Planning Conversation (RM 570): A one-to-one session to discuss your wishes regarding the distribution of your estate, covering will preparation (wasiat), hibah arrangements, and trust considerations. A written summary is prepared following the session.
• Estate Administration Support (RM 1,230): Assistance for families navigating the administration of a deceased's estate, including guidance on probate or letters of administration, preparation of required documentation, and liaison with relevant authorities.
• Complete Lasting Legacy Engagement (RM 1,900): A comprehensive arrangement covering planning, administration, and distribution, with case management, beneficiary coordination, and preparation of a consolidated estate record under applicable faraid or civil principles.

Services are delivered in Malaysia and are subject to Malaysian law. We reserve the right to decline instructions where a conflict of interest arises or where the matter falls outside our scope of practice.

4. User Responsibilities

When engaging our services, you agree to:

• Provide full, accurate, and timely information as reasonably required to deliver the service.
• Notify us promptly of any changes in circumstances relevant to your matter.
• Treat all members of our team with respect and courtesy.
• Not use our services in connection with any unlawful activity or for the purpose of concealing assets.
• Keep confidential any advice or documentation provided to you that is not intended for public disclosure.
• Meet payment obligations within the agreed timeframes.

We reserve the right to suspend or conclude the engagement if these responsibilities are not met.

5. Intellectual Property

All methodologies, templates, processes, and general materials developed by Lestari in the course of delivering services remain the intellectual property of Lestari. You are granted a limited, non-exclusive licence to use documents and written summaries prepared specifically for your matter, for the personal or family purposes for which they were created.

You may not reproduce, distribute, or repurpose Lestari's proprietary materials for commercial purposes without prior written consent.

6. Payment Terms

• Fees are quoted in Malaysian Ringgit (RM) and are fixed as stated in the service schedule.
• Payment is due in accordance with the engagement letter. For certain services, an initial payment may be required before work commences.
• Accepted payment methods include bank transfer and such other methods as communicated at the time of engagement.
• Where a matter is concluded earlier than anticipated or does not proceed, fees will be assessed in proportion to work completed, and any balance will be refunded within 14 working days.
• If you have concerns about fees at any stage, please raise them with us and we will address them with care.

7. Service Delivery Terms

• The scope of each engagement is set out in the relevant service description and any engagement letter issued.
• Timelines are estimates and may be affected by third-party processes (such as court timelines, authority queues, or document availability). We will keep you informed of material developments.
• Any significant changes to the scope of work will be discussed with you and documented before proceeding.
• Confidentiality of all client information is maintained throughout the engagement and after its conclusion, in accordance with applicable professional and legal obligations.

8. Disclaimers

Lestari provides guidance and assistance based on the information supplied and applicable law at the time of engagement. We wish to be clear:

• Outcomes in estate administration are subject to court discretion, authority decisions, and the cooperation of third parties. We cannot warrant any particular result.
• This service does not constitute legal representation unless specified in writing. For matters requiring formal legal representation, we will advise you accordingly.
• Changes in law or regulation after the date of our advice may affect its applicability. We recommend periodic reviews for planning arrangements.
• Information on this website is for general understanding only and does not constitute personal legal advice.

9. Limitation of Liability

To the fullest extent permitted under Malaysian law:

• Our total liability to you in connection with any engagement shall not exceed the fees paid for that specific service.
• We shall not be liable for indirect, incidental, or consequential losses, including loss of anticipated inheritance, delays caused by third parties, or outcomes determined by courts or authorities.
• Nothing in this clause excludes liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.

10. Indemnification

You agree to indemnify and hold Lestari harmless from any claims, losses, or expenses (including reasonable legal costs) arising from your provision of inaccurate information, your breach of this Agreement, or your use of our services in a manner inconsistent with their intended purpose.

11. Termination

• Either party may conclude the engagement by giving reasonable written notice. We will confirm completion of work done and any applicable refund.
• We may decline to continue an engagement if circumstances arise that make it impractical, or if our professional obligations require us to step back.
• Provisions relating to confidentiality, payment of fees for work completed, and dispute resolution survive the conclusion of the engagement.

12. Dispute Resolution

• This Agreement is governed by the laws of Malaysia.
• Any dispute arising from this Agreement shall first be addressed through direct discussion between the parties, with a view to reaching a mutually acceptable resolution within 30 days.
• If the matter cannot be resolved informally, the parties agree to attempt mediation before commencing any legal proceedings.
• The courts of Malaysia shall have jurisdiction over any dispute that cannot be resolved through the above means.

13. General Provisions

• Entire Agreement: This Agreement, together with any engagement letter, constitutes the entire understanding between the parties in respect of the services described.
• Severability: If any provision of this Agreement is found to be unenforceable, the remaining provisions continue in full effect.
• Waiver: A failure to enforce any provision does not constitute a waiver of the right to enforce it in future.
• Assignment: You may not transfer your rights under this Agreement without our prior written consent.
• Notices: Formal notices may be sent by email to [email protected] or by post to our registered address.

14. Changes to Terms

We may update these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or our practices. Material changes will be communicated by updating the "Last Updated" date on this page. Continued use of our services after any change constitutes acceptance of the revised terms. We encourage you to review this page periodically.
